TERMS AND CONDITIONS OF USE DIGITAL CHANNEL

TERMS OF USE

  1. The use of our website and digital channels certifies the full, direct and conscious acceptance of each of the provisions included in these terms and conditions. By using the website, the User expresses his acceptance of the TERMS AND CONDITIONS.
  2. Some of the services that we offer and that are provided by third-party companies, have particular characteristics of the service offered and, depending on the case, could replace or complement these terms and conditions.
  3. The use, navigation and access to our website are free, however, the services we offer are subject to payment for such provision. Spirit to Travel may in some cases include an amount for such benefit or assistance, which may be indicated clearly and precisely in the purchase process.
  4. All tour reservations made through our website, Spirit to Travel or other means used by the agency are processed immediately after receiving the payment for this, purchases of bus tickets, flights depending on the tour and some other tickets of attractions are instantly booked.
  5. If you do not receive the confirmation emails due to problems with your emails, servers or companies that provide you with the email service or the information entered is not correct, Spirit to Travel does not accept any responsibility derived from this fact. Remember to check your email accounts 24 to 48 hours after making your reservation, try to keep in touch with an advisor.

BOOKING

  1. By booking or participating in a Service with SPIRIT TO TRAVEL through our website, digital media or any other means, you are accepting these terms and conditions.
  2. Your Reservation is confirmed and a contract exists when the company or its travel agent issues a written confirmation upon receipt of the corresponding deposit amount.
  3. You will pay a deposit that is not refundable in any case. There are no exceptions.
  4. You will be asked to show the original passport (not a copy) with which you made the reservation, at the checkpoint to enter the Inca Trail and other places. If you originally booked with an old passport and then renewed your passport, you must also bring your original expired passport along with your new, valid passport to allow entry or you will be denied entry to the trail and other venues.
  5. The only acceptable ID to receive a student discount is a university ID with a clear expiration date that must be the same year as the trek. Cards with an expiration date of the following year, even if they are clearly valid, will not be accepted by the Peruvian government. You must present a copy of this card at the time of booking (along with the original).
  6. The accommodations included in the tours are referential. The hotels offered are the first option, but if there is no availability at the reserved tour hotel, the agency guarantees another hotel of the same quality, prior notice to the user before the reservation.

USER RESPONSIBILITY

  1. All the information entered by the User at the time of making their reservation is assumed to be valid, considering that they have correctly entered their data, as it appears on their valid and current Identity Document (ID/DNI/Passport, Immigration Card, etc.) . Once the services have been reserved and paid for, no corrections and/or modifications are possible.
    For this reason, the client must carefully verify the information sent at the time of making the reservation, make sure that the names and number of documents are exactly those that appear in the passport or others. Immediately report any incorrect or incomplete information to the company or authorized agent.
  2. The rates and conditions apply according to the itinerary and travel dates requested by the User.
  3. It is the User’s obligation to correctly fill in the data, the selection of dates, destinations and other specifications for the acquisition of the service. The agency is absolved of all responsibility, since the data is provided and filled out by him.
  4. It is a requirement to be of legal age to acquire our services through our digital channels.
  5. The user will be attentive to the information that the Agency sends through his email to the email address that the user sent for said reception, it will be assumed that he took timely knowledge of the confirmation of his reservation.
  6. The User declares that he is informed of the conditions that are required in each selected tourist destination, having verified, with due anticipation, the conditions of entry to said country or the selected final destination, the conditions on the requirement of vaccinations, permits for entry of minors, clothing according to the weather and others.
  7. Rates are expressed in Dollars (USD) or with the current exchange rate in Soles and are subject to availability and/or until stocks last.

COLLECTION POLICY

  1. All documentation for payments will be sent to the user digitally (by email, mobile devices or any digital channel always confidentially).
  2. Forms of payment for the user:
    a. Through the use of PayPal, which is a digital platform that facilitates payments over the internet
    b. Through the use of international or national bank transfers
  3. The payment vouchers will be issued digitally and sent to their respective email.

CANCELLATION OF TOURIST SERVICES

  1. If the cancellation is made outside of the days in advance, depending on the destination of your package or tour, the penalty will be 100% of the service, that is, no type of refund will be considered for any reason.
  2. The user will be provided with all the facilities to modify or change the date of the services, subject to the Provider’s policies and the availability of the new dates.
  3. Once the sale is closed, any correction of data is subject to payment or penalty by the entity providing the service plus administrative expenses, other types of modifications must be consulted in a particular way with your travel advisor.
  4. Reservations may be partially or totally canceled or canceled in accordance with the purchasing policies of each provider (airlines, hotels, transport companies, among others).
  5. Certain services may be interrupted or canceled due to weather conditions, force majeure or other reasons beyond the control of hotels, airlines, suppliers or partners. No refunds will be given as a result of these interruptions or cancellations beyond our control and that of the operators.

REFUNDS

  1. If a refund is applicable, it will be made within 7 business days of receiving the refund from the respective provider, making this refund to the bank account, credit card or other means of payment with which the user has made the purchase, discounting the bank and administrative expenses of Spirit to Travel and the suppliers.
  2. Take into account that international or domestic air tickets will follow the refund and cancellation policies of the airlines, likewise, train services, transportation services, entrance to archaeological centers and other tourist providers, will follow the refund and cancellation policies of each entity.
  3. Passengers will not be entitled to reimbursement of funds for acts outside the agency such as failure to present current identity documents and those with which the tour was booked, for presenting invalid documents, for not complying with current laws of the country, strikes, weather problems or any other reason not caused by Spirit to Travel.

SERVICES OFFERED, COMMITMENTS AND LIABILITY OF SPIRIT TO TRAVEL

  1. Through our digital channels, Spirit to Travel presents itself as an online tourism operator agency, which fulfills the role of organizer and intermediary between the User and the hiring of providers of tourist services, transport and hotel services, which operate with us. We inform you about its characteristics or conditions, we manage your requests for reservations and purchases, we collect the values corresponding to the prices and we support you in the search for solutions when you have a concern or inconvenience. The providers of tourist services, transport services and hotels, are the ones who transport and accommodate consumers, their families and their luggage.

    Spirit to Travel is not responsible for acts of God or force majeure, climatic phenomena that occur before or during the development of the services in a way that complicate the total or partial execution of these, as well as for changes in schedules, cancellations and/or rescheduling of flights, cruises, trains, buses; however, as we have indicated in the previous paragraph and as intermediaries, Spirit to Travel will offer all the help so that the User obtains a solution to the extent that he can apply the criteria of our operators, always acting as an intermediary.

    The rates displayed on our web portal and/or web components for each type of service offered are governed in accordance with the providers’ policies and will be detailed according to the information provided. Commissions or other charges may be applied and will always be visible and clear to the User or Registered User.
